These Terms and Conditions (“Agreement”) govern participation in the Clover-Gold Affiliate Program (“Program”). By enrolling and participating, you agree to abide by these terms.
1. Definitions
- Affiliate: An individual or entity approved to promote Clover-Gold.
- Affiliate Account: The registered account provided to Affiliates upon approval.
- Net Revenue: Revenue generated by referred players, minus bonuses, refunds, chargebacks, and applicable fees.
- Referral Link: A unique tracking URL assigned to each Affiliate.
- Commission: The percentage of Net Revenue paid to the Affiliate for qualifying referrals.
2. Enrollment
- To participate, Affiliates must complete the application process and receive approval from Clover-Gold. Approval is at Clover-Gold‘s sole discretion.
- Applicants must provide accurate information and comply with applicable laws and regulations.
3. Affiliate Obligations
- Promotion: Affiliates are responsible for promoting Clover-Gold using their unique Referral Link.
- Compliance: Affiliates must:
- Avoid promoting to minors or in jurisdictions where online gambling is prohibited.
- Avoid making misleading claims about potential earnings or Clover-Gold‘s services.
- Comply with anti-spam laws and refrain from using unsolicited emails or ads.
- Content Use: Affiliates may only use approved marketing materials provided by [Casino].
- Prohibited Activities: Affiliates must not:
- Create fake accounts or artificially inflate traffic.
- Engage in unethical practices such as cookie stuffing or trademark bidding.
4. Commission Structure
- Payout Rates: Commissions are calculated as a percentage of Net Revenue and vary by monthly performance:
- 0-10 referred players: 10%
- 11-20 referred players: 25%
- 21+ referred players: 45%
- Payment Terms: Payments are made monthly, provided the Affiliate meets the $50 minimum threshold.
- Inactivity Policy: If an Affiliate generates no revenue for six consecutive months, their account may be deactivated, and unpaid earnings forfeited.
5. Tracking and Reporting
- Affiliates are responsible for ensuring the proper use of their Referral Link.
- Tracking and performance reporting tools are provided via the Affiliate Dashboard.
- Discrepancies in tracking must be reported within 30 days.
6. Term and Termination
- Term: This Agreement begins upon acceptance and remains in effect until terminated by either party.
- Termination: Either party may terminate the Agreement with 30 days’ written notice. Immediate termination may occur if the Affiliate violates any term of this Agreement.
- Post-Termination: Upon termination, all rights and licenses granted to the Affiliate are revoked, and unpaid commissions may be forfeited in cases of violation.
7. Confidentiality
Affiliates must not disclose any proprietary or confidential information provided by Clover-Gold.
8. Liability
- Clover-Gold is not responsible for:
- Technical issues affecting tracking or performance.
- Indirect or consequential damages arising from participation in the Program.
- Affiliates agree to indemnify Clover-Gold against claims or liabilities resulting from their activities.
9. Amendments
Clover-Gold reserves the right to modify this Agreement at any time. Changes will be communicated via email or the Affiliate Dashboard. Continued participation in the Program constitutes acceptance of the updated terms.
10. Governing Law
This Agreement is governed by the laws of the designated country, without regard to conflict-of-law principles.
11. Miscellaneous
- Entire Agreement: This Agreement represents the entire understanding between Clover-Gold and the Affiliate.
- No Partnership: Participation in the Program does not establish a partnership, joint venture, or agency relationship between the parties.
By registering as an Affiliate, you confirm that you have read, understood, and agree to comply with these Terms and Conditions.
